The Bach Strategy Client Agreement

 

Thank you for selecting the Bach Strategy to enhance your desert weekend experience! We are dedicated to delivering an unforgettable time for you and your group.

 

This document, referred to as the "Service Agreement," outlines the expectations and terms under which the Bach Strategy will provide its services to you, the valued Client. It's important to carefully review this agreement, as it pertains to your legal rights.

 

Purchased Services: The Bach Strategy commits to providing the services detailed in your invoice or invoices ("Services") for the specified date and time. To confirm bookings, full payment and a signed Service Agreement are required. All invoices are considered part of this Service Agreement. If any invoice conflicts with this Agreement, the terms of the Service Agreement will take precedence.

 

Payment Method: Payments for rendered services will be made in US Dollars through the Bach Strategy's invoice payment system or another mutually agreed-upon method.

 

Service Area: The Bach Strategy operates within a defined service area encompassing Las Vegas, including Henderson and Summerlin. If your location falls outside this Service Area or changes after notification, a minimum travel fee of $150 might apply, and adjustments to setup time could occur. We will inform you within 24 hours of any additional charges or timing changes after receiving your final location.

 

Arrival and Setup: Our aim is to arrive punctually at the time indicated on your invoice. In rare cases of delay, we'll communicate an estimated arrival time. Decorating setup usually takes up to 2 hours.

 

Decoration Quality: We strive to create impressive decorations using high-quality materials that contribute to an exceptional party atmosphere. Over time, decorations might experience wear, deflation, or falling.

 

Client-Sent Packages: The Bach Strategy is not responsible for any issues arising from items shipped to us by you, such as shipping delays, damage, or missing items.

 

Alcohol in Decorations: Some decoration packages may include alcohol. It's your sole responsibility to adhere to alcohol consumption laws and regulations, including not serving alcohol to those under 21. You are liable for any damages resulting from alcohol provision, releasing the Bach Strategy from associated claims. Before services commence, please email a copy of your photo ID to hello@thebachstrategy.com.

 

Cancellation: If Services are canceled by the Client, a 50% cancellation fee applies. Refunds, minus the fee, will be processed using the original payment method.

We understand that plans can change. If you need to cancel or reschedule, please contact us as soon as possible.

Here’s our cancellation and rescheduling policy:

  • Mini and Ultimate Decor Packages:

    • 30+ days before the event: Full refund of the total amount.

    • 2 weeks or less before the event: 50% refund of the total amount.

  • Custom Parties:

    • 30+ days before the event: 50% refund of the deposit.

    • 2 weeks or less before the event: No refund of the deposit.

Rescheduling is subject to availability, but we will do our best to accommodate your new date.

 

Cleanup: You are responsible for cleaning up all décor items from the package you've chosen. If applicable, the Bach Strategy will retrieve rentals between 7am - 11am on your departure day, possibly earlier in certain cases. To minimize waste, please return reusable items like table confetti, unused straws, and decorations. Check out the packages available here

 

Damaged or Missing Items: Should rental items listed in your invoice be damaged or missing, you're financially liable for replacing them or paying replacement costs. Please handle rental items with care.

 

Substitutions: Rarely, the Bach Strategy may need to substitute elements of the decoration package due to availability. We will inform you and obtain your approval before making any substitutions.

 

Third-Party Providers: The Bach Strategy may suggest third-party service providers (e.g., Private Chef, Transportation). We bear no responsibility for any issues arising from such arrangements. By working with these third parties, you release the Bach Strategy from associated claims.

 

Contact During Stay: If you have concerns or questions about our services during your stay, feel free to text us at 702.509.4464. We'll respond within 8 business hours.

 

Warranty: Services from the Bach Strategy are provided "as-is" without express or implied warranties.

 

Liability Limitation: Your use of Bach Strategy Services implies acceptance of all foreseeable and unforeseeable risks. We're not liable for direct, indirect, or consequential damages, even if such damages were reasonably foreseeable.

 

COVID Guidelines: The Bach Strategy has the right to enforce COVID safety directives for clients and their parties. If you've had COVID, wait 5 days from symptom onset before using our services, and wear a mask for the following 5 days.

 

Severability: If any clause in this Agreement is deemed invalid by a court, it won't affect the remaining provisions. Parties direct the Court to amend the Waiver as necessary to legally fulfill the intention of minimizing Bach Strategy's liability.

 

Choice of Law; Venue: This Service Agreement is governed by Nevada law. Any disputes will be addressed in the Courts of Nevada, Clark County.

14-Day Refund Policy for Online Store Purchases

  1. Scope of Policy: This refund policy applies exclusively to products purchased through the online store of Bach Strategy.

  2. Refund Eligibility Period: Customers are eligible for a refund on products purchased if a refund request is made within 14 days from the date of delivery.

  3. Condition of Returned Products: Products must be returned in their original condition, unopened, and unused. Products that are damaged, altered, or not in their original packaging will not be eligible for a refund.

  4. Initiating a Refund Request: To request a refund, customers must contact Bach Strategy's customer service via email or through our online contact form, providing the order number, purchase date, and a reason for the request.

  5. Return Shipping: Customers are responsible for the cost of return shipping. We recommend using a trackable shipping service, as Bach Strategy is not liable for any returned items lost in transit.

  6. Refund Processing: Upon receiving the returned product and confirming its condition, the refund will be processed within 7 business days. The refund will include the original purchase price of the product but exclude any shipping costs.

  7. Refund Method: Refunds will be issued to the original payment method used at the time of purchase. If this is not possible, Bach Strategy will arrange an alternative refund method with the customer.

  8. Exclusions: Certain products, such as personalized items, perishable goods, or special orders, are not eligible for a refund. These exceptions will be clearly stated on the product’s purchase page.

  9. Exchange Option: Instead of a refund, customers may opt for an exchange of the product, subject to availability. The same conditions as stated above apply to exchanges.

  10. Policy Updates: Bach Strategy reserves the right to modify this refund policy at any time. Customers are advised to review it periodically for any changes.

Mobile Experiences and 3rd Party Vendors

​​These Terms & Conditions are important, as together with your Third Party Provider booking confirmation email and any terms and conditions as provided by the Third Party Provider, set out the legal terms on which the products or services purchased from the Third Party Provider are made available to you.

 

When you book a product or service with a Third Party Provider through Bach Strategy, Bach Strategy is responsible for the platform but not for the Third Party Provider product, service, or experience itself.

 

Your purchase and use of the Third Party Provider products or services booked through this website are conditioned upon your acceptance of these Terms & Conditions (“Purchase”). If you do not accept these Terms & Conditions, please do not use our site to book Third Party Provider goods or services.

 

We may change these Terms & Conditions at any time and your future Purchase following changes to these Terms & Conditions is subject to accepting those updated Terms & Conditions.

 

THIRD PARTY SERVICE. This service is provided by a Third Party Provider, and Bach Strategy is not a party to the terms between you and the Third Party Provider. The Purchase may be subject to additional terms and conditions as provided by the Third Party Provider. Your service is not confirmed until the provider contacts you directly to confirm. You will receive the provider's contact information in an email confirmation from the provider.

 

LIABILITY. Bach Strategy shall have no liability or responsibility to you relating to the Purchase and the services and products provided thereunder by a Third Party Provider except for the case of Bach Strategy’s fraud, gross negligence, or willful misconduct as it relates to the Purchase.

 

WARRANTY. Bach Strategy takes reasonable care in providing a description of the Purchase, but cannot guarantee its accuracy. Bach Strategy shall not make any warranties, express or implied, as to the condition of the Purchase or the services provided thereunder, and there are no expressed or implied warranties of merchantability or fitness for a particular purpose or use. We accept no liability for ensuring the Purchase is appropriate for your objectives. Purchaser agrees to indemnify and hold harmless Bach Strategy, its affiliates and officers, directors, and employees against any and all judgments, damages, costs, or losses of any kind (including reasonable attorneys’ fees) as a result of any claim, action, or proceeding that is based on the Purchase.

 

DEPOSIT AND PAYMENT. The total amount quoted for the Purchase shall include the amount of the products and services as described, taxes and service fees, which is paid directly to the Third Party Provider, less Bach Strategy's finders fee (“Purchase Amount”). The deposit paid will be applied towards the Purchase Amount. If your desired date and time are not available, your deposit will be refunded. If the service is canceled by the Third Party Provider, a full refund will be provided. The remaining balance is due to the provider.

 

TAXES & FEES. You acknowledge and accept that tax obligations including facilitation fees and services fees where applicable shall be included in the purchase price. Bach Strategy receives a finders fee for the products or services booked through Bach Strategy. The payment for the activity is transferred directly to the Third Party Provider. Gratuity and optional upgrades are not included.

 

BREACH. If you breach these Terms & Conditions or those of the Third Party Provider, Bach Strategy shall not be liable for any costs you incur as a result, and you will not be entitled to a refund.

 

GOVERNING LAW. These Terms & Conditions are governed by the laws of the State of Arizona, without regard to principles of conflict of laws.

 

SEVERABILITY. If any of these Terms & Conditions are found to be invalid or unenforceable by a court of law, the clause shall be enforced to the fullest extent permitted by law and all other terms herein shall remain in full force and effect.
